Principles of Contract Management and Administration - FIDIC Approved Module 4

Overview

The Building, construction and engineering industry has various forms available which may be used as a basis for drafting contracts. However, in the application of these contract forms, there are certain principles of the administration & management of contracts themselves which are common to all and applicable to the good handling of each type of contract form.
This course focuses on certain basic principles which should be adopted to ensure: » Launching the process of contract administration and putting it on a proper footing – personnel appointments; » Keeping of proper records; » Correct, timeous and unambiguous application of the main provisions of the various contracts, particularly formal notices to be given; » Procedural check-lists to be implemented at the various levels of contract administration; » Importance of first site meeting (kick-off meeting) to establish rules for interacting on site; » Importance of the Contractor’s Programme for carrying out the works; » Insurance and warranty aspects; » Payment on time in terms of the contract; » Dealing with variations; » Dealing with claims; » Proper handling of dispute resolution The course material is interactive and uses case studies to illustrate the points made. Many topics, such as delay and disruption events, force majeure claims and termination procedures can be dealt with only briefly but illustrate the broader problems typically experienced in contract administration, which the administration staff should at least be aware of and recognize when to seek further assistance. This course attempts to give a fairly broad introduction to the very detailed and important field of construction contract administration.
